PIPEDA Compliance for Ontario Law Firms, From Safeguards to Breach Records
ACT360 helps Ontario law firms with the technical side of PIPEDA. We put safeguards around client personal information, set up breach response and a 24-month breach record, and document it so your privacy officer can show the work.
It’s part of our IT support for Ontario law firms, alongside cybersecurity for law firms.
What Does PIPEDA Expect From an Ontario Law Firm?
PIPEDA expects a law firm to follow 10 fair information principles for the personal information it handles commercially. For IT, the key ones are accountability, safeguards proportional to sensitivity, and the breach reporting and record-keeping rules.
The Office of the Privacy Commissioner’s safeguards principle says personal information must be protected against loss, theft and unauthorized access, regardless of how it is stored, with physical, organizational and technological measures. The accountability principle requires a designated person, written policies, staff training, and protection of information you hand to third parties for processing.
A quick word on scope. We’re an IT firm, not your privacy counsel. We handle the safeguards, breach readiness and documentation, and we’ll tell you when a question belongs with a lawyer. For the broader privacy law, see our PIPEDA compliance guide for Ontario businesses.
Where IT Fits Into PIPEDA Compliance for a Law Firm
Here’s how each obligation translates into work at your firm, and the part ACT360 takes on.
The OPC’s guidance on mandatory breach reporting covers the reporting test and the 24-month record in detail.
What’s Included in PIPEDA Support for Law Firms
The technical and operational pieces most firms are missing, put in place and documented.
Safeguards Review
Access, encryption, devices, backups and cloud settings checked against the safeguards principle.
Access and Offboarding
Role-based access to client files, and departing staff removed from every system.
Breach Response and Records
An incident response plan, plus a breach log kept for the 24 months PIPEDA requires.
Staff Training
Security awareness and phishing training, so the people handling client data know the risks.
How Is PIPEDA Different From Your LSO Obligations?
PIPEDA governs personal information collected in commercial activities, while the Law Society of Ontario’s rules govern your duty of confidentiality to clients. The two overlap, and the same safeguards usually serve both.
LSO Rule 3.3-1 covers all information about a client’s business and affairs, not just personal information. So a firm that meets PIPEDA’s safeguards for personal data but leaves corporate transaction files wide open still has a problem. Our guide to law firm data security requirements in Ontario sets the LSO rules, PIPEDA and LAWPRO side by side.
Where Do Law Firms Usually Fall Short on PIPEDA?
Most gaps are practical, not legal. Firms often know the principles but have no breach log, no written incident plan, and access that was never reviewed after staff changed.
- No breach record at all, so small incidents like a misdirected email go unlogged.
- Shared logins for practice software, which makes access impossible to audit.
- Laptops without encryption, so a stolen bag becomes a reportable breach.
- Client documents sent as plain email attachments by default.
- A privacy officer in name only, with nothing written down to show.
Most of these are fixable quickly once someone actually owns them.
What Does PIPEDA Support Cost?
For firms on ACT360 Managed IT at $80 to $150 CAD per user per month, ongoing compliance support like patching, posture reviews and security fundamentals is part of the service. Standalone setup work is quoted after the assessment.
The quote depends on how many systems hold client information, how many offices you have, and what’s already in place. Our guide to how much IT support costs a law firm breaks down the Managed IT fee by firm size.

What Law Firms Ask About PIPEDA Compliance
Not on its own, and you should be wary of anyone who says otherwise. Compliance covers consent, purposes, retention and access requests as well as security, and the legal interpretation belongs with your privacy counsel. What we handle is the technical and operational side, the safeguards, breach readiness and documentation, which is where most firms have the biggest gaps.
Usually a partner or the office manager, someone with the authority to act on privacy issues. PIPEDA requires an organization to designate an individual who is accountable for compliance, and the OPC recommends that person has senior management support.
No, only breaches that create a real risk of significant harm must be reported to the OPC and affected individuals. Every breach involving personal information still has to be recorded and kept for 24 months, including the small ones that didn’t meet the threshold.
PIPEDA doesn’t ban it, but you stay responsible for personal information you transfer to a third party for processing. The OPC says organizations should use contractual or other means to make sure a provider outside Canada offers comparable protection. In practice that means knowing where your data is stored, what the provider’s terms say, and securing the account properly with MFA and sensible sharing settings.
The timeline depends on how many systems hold client information and what’s already in place. We’ll give you a specific, phased plan after the assessment, so you know what happens first and when.
